By accessing or using the HotSpot mobile application and services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Eligibility

You must be at least 18 years old to use HotSpot. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3. Account Registration

3.1 Account Creation

  • You must provide accurate, complete, and current information
  • You are responsible for maintaining account security
  • You must not share your account credentials
  • You are responsible for all activities under your account

3.2 Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or illegal activity.

4. User Conduct

You agree not to:

  • Use the Service for any illegal purpose
  • Harass, abuse, or harm other users
  • Impersonate any person or entity
  • Post false, misleading, or defamatory content
  • Spam or send unsolicited communications
  • Attempt to gain unauthorized access to the Service
  • Use bots, scrapers, or automated tools
  • Interfere with the Service's operation
  • Violate any applicable laws or regulations

5. Check-Ins and Location Services

  • Check-ins must be made at actual venue locations
  • Fraudulent check-ins will result in account suspension
  • You control when and where to check in
  • You control who can see your check-ins

6. Promotions and Hot Alerts

6.1 User Responsibilities

  • Promotions must be redeemed according to venue terms
  • Each promotion code can be used only once
  • Promotions cannot be transferred or sold
  • Venues reserve the right to refuse service

6.2 No Guarantee

We do not guarantee availability of promotions or venue participation. Promotions may be modified or cancelled by venues at any time.

7. Intellectual Property

7.1 Our Content

All Service content, including logos, designs, text, graphics, and software, is owned by HotSpot and protected by intellectual property laws.

7.2 Your Content

You retain ownership of content you post. By posting, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content in connection with the Service.

8. Third-Party Services

The Service may integrate with third-party services (e.g., payment processors, mapping services). We are not responsible for third-party services and their terms apply separately.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We disclaim all warranties, express or implied, including:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy, reliability, or availability

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • We are not liable for indirect, incidental, special, or consequential damages
  • Our total liability is limited to $100 or the amount you paid us in the past 12 months, whichever is greater
  • We are not responsible for venue conduct, promotions, or service quality
  • We are not liable for user interactions or disputes

11. Indemnification

You agree to indemnify and hold harmless HotSpot, its officers, directors, employees, and agents from any claims, damages, or expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another

12. Privacy

Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference.

13. Modifications to Service

We reserve the right to:

  • Modify or discontinue the Service at any time
  • Change features, pricing, or availability
  • Update these Terms periodically

Continued use after changes constitutes acceptance of new Terms.

14. Termination

You may terminate your account at any time through app settings. We may terminate or suspend access immediately for any reason, including Terms violations.

15. Dispute Resolution

15.2 Arbitration

Disputes not resolved informally will be settled by binding arbitration, not court proceedings, except for small claims court matters.

15.3 Class Action Waiver

You waive the right to participate in class actions or class arbitrations.
